Süddeutsche Zeitung - The unsolvable conflict in Poland

The recent Constitutional Court decision in Poland left the EU reeling. Deputy Director Lucas Guttenberg weighs in on the conflict. 

Following the recent Polish Constitutional Court ruling which declared that EU law can sometimes be trumped by domestic constitutional law, many comparisons have been made with the 2020 ruling by the German Federal Constitutional Court, which also dealt with issues of domestic versus EU jurisdiction. However, Lucas Guttenberg warns that this is comparing "apples and oranges" and says that the Polish case deals with "a government that has actively positioned a politically controlled constitutional court to torpedo the EU legal order."
